Brutal Legend will be released in October.

Slap bang in the middle of this year's E3, news broke which revealed that Activision Entertainment Holdings filed a suit against Double Fine over the upcoming rock and roll adventure Brutal Legend.

Eurogamer is reporting today that Double Fine is now countersuing Activision, alleging that the mega-publisher is trying to "kill (Brutal Legend) completely."

    Now Double Fine alleges Activision is blocking the release because it wants to fend off competition for the Guitar Hero series. The lawsuit claims Activision's aim "is not only to cancel Brutal Legend, but to kill it completely".

    Double Fine's not going to take it lying down, though. "Now that we've found a publisher and the game is getting sensational coverage, they want to stop its release," said studio bigwig Caroline Esmurdoc.

    "Double Fine's countersuit is a demonstration of our intention to fight for this game - Activision will not kill Brutal Legend."

There's currently no indication that these legal wranglings will interfere with the solid release date of Rocktober (cheers Luke  :)) 13th on both Xbox 360 and PlayStation 3.

The judge presiding over the Brutal Legend legal battle has delayed his decision until next week - but warned he's unlikely to rule in Activision's favour.

Activision filed a lawsuit in June, claiming it invested $15 million in Brutal Legend and owns the rights. The publisher is attempting to block Electronic Arts from releasing the game, which is currently down for an October launch.

Developer Double Fine waded in earlier this month, filing a countersuit against Activision.

So it's left to Los Angeles Superior Court judge Craig Karlan to decide who's right and who's wrong, like some kind of Jeremy Kyle of videogames.

According to the Associated Press Double Fine is due to deliver a final version of the game by 8th August. Karlan has said he needs a bit more time to think but will make his ruling before then, on the 6th.

It's not looking good for Activision, though - the judge said he is leaning against ordering a delay to the release of the game.

"I can't say there's a likelihood of success here," Karlan said. However, he added, "This is going to be a close call."

EA has that new dude in charge who made the FIFA team do some work and made Mirrors Edge and Dead Space. two of my fave games of last year!

The soundtrack for Brutal Legend has been leaked.
EA Denmark posted up the soundtrack before quickly realising its error and whipping the page offline again, but not before a screencap had been taken.

And thus, courtesy of Kotaku, we now have the full tracklist for Brutal Legend. Unsurprisingly, it features a lot of metal, from Anvil through to Scorpions. It also features Megadeth spelt incorrectly but we're not sure if that's Kotaku's fault or EA's. Just one of those things, we suppose.
